These practices threaten the integrity of elections, especially when used to distort the image of candidates or confuse voters about political issues.

Given the lack of specific regulations for AI in Congress, the TSE decided to act and establish clear guidelines for the use of this technology during the election period. The intention is to prevent it from being used in a way that negatively influences voters' decisions, ensuring that the election is decided based on truthful information and the debate of real proposals.

Main TSE rules for the use of AI

AI-generated content labeling: All multimedia content produced using artificial intelligence must be clearly identified. This includes videos, audio, images or any other material that has been digitally manufactured or manipulated. This requirement aims to ensure that voters know when they are consuming artificially generated content, avoiding confusion between what is real and what is manufactured.

Prohibition of deep fakes: The creation and dissemination of deep fakes, that is, content that alters or simulates the voice and image of people in a misleading way, is completely prohibited. This measure aims to prevent the distortion of reality through digital montages, which can be used to create false speeches or scenarios that are harmful to candidates or parties.

Restriction on the use of chatbots and avatars: During the election period, the use of AI to simulate conversations with voters through chatbots or avatars that appear to be real people is prohibited. The prohibition aims to prevent voter manipulation through artificial interactions that could create a false impression of direct dialogue with the candidate or their representatives.

Responsibility of digital platforms: Social networks and messaging apps are also under increased surveillance. Internet application providers are required to remove content that promotes anti-democratic acts, hate speech or prejudice, without the need for a court order. This mechanism ensures faster action in the fight against disinformation.

The importance of regulation in the electoral scenario

The use of artificial intelligence without proper regulation can create an environment conducive to electoral manipulation, undermining trust in the democratic system. The TSE’s decision to establish clear rules for the use of this technology is seen as a fundamental step towards preserving the integrity of elections, ensuring that the will of the people is expressed freely and in a well-informed manner.

The new measures demonstrate that the Electoral Court is aware of technological advances and is willing to act to prevent them from being used for harmful purposes. By protecting voters against misinformation and ensuring that campaigns are based on real facts, the TSE reinforces its role as guardian of democracy.

With the advancement of technology, especially the increasing use of artificial intelligence (AI), the Superior Electoral Court (TSE) has implemented new rules to ensure that the electoral process remains fair and transparent, even in a scenario of digital transformation.
