{"id":4914,"date":"2024-08-30T02:27:56","date_gmt":"2024-08-30T02:27:56","guid":{"rendered":"https:\/\/renovabr.org\/?p=4914"},"modified":"2024-08-30T02:27:56","modified_gmt":"2024-08-30T02:27:56","slug":"comunidade-alumni-renovabr-debate-mudancas-na-legislacao-eleitoral-durante-conversa-360o","status":"publish","type":"post","link":"https:\/\/www.renovabr.org\/en\/comunidade-alumni-renovabr-debate-mudancas-na-legislacao-eleitoral-durante-conversa-360o\/","title":{"rendered":"RenovaBR Alumni Community discusses changes in electoral legislation during 360\u00ba Conversation"},"content":{"rendered":"<p>In August, the RenovaBR Alumni Community had the opportunity to participate in another edition of Conversa 360\u00ba, an event that promotes in-depth discussions on crucial topics for Brazilian public life.&nbsp;<\/p>\n\n\n\n<p>In this edition, the focus was on electoral legislation, with the presence of Jamil Assis, Director of Institutional Relations at Instituto Sivis, and Andr\u00e9 Marsiglia, lawyer, legal consultant at Instituto Sivis and specialist in Freedom of Expression and the Press.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Digital platform liability: a new era<\/strong><\/h3>\n\n\n\n<p>During the meeting, Jamil Assis highlighted the importance of the new electoral resolution that introduces significant changes to the liability regime of social media platforms. He explained that, previously, these platforms were governed by the Internet Civil Rights Framework, which established that liability fell on them only if they failed to comply with the removal of content following a court order.<\/p>\n\n\n\n<p>\u201cNow, with this new resolution, there is a change in this regime, requiring greater proactivity from platforms. They become protagonists and will be punished if they do not take measures on their own. It is not enough to simply obey court decisions; they need to proactively take initiatives to remove from the air what is not permitted according to this resolution,\u201d said Jamil Assis.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Subjectivity and risks in the application of new standards<\/strong><\/h3>\n\n\n\n<p>Andr\u00e9 Marsiglia brought to light the complexities and challenges that the application of this new legislation can bring, especially due to the subjectivity involved.&nbsp;<\/p>\n\n\n\n<p>\u201cThe problem is that this resolution, 2,374, has already existed on other occasions, but has never been put into practice. No judge has ever applied these resolutions. It is obvious that this brings problems, as if we were improvising a play. Even if it is a work by Shakespeare, if you have never played that character, if it is the first time you are reading or performing that text, there is a great chance that something will go wrong,\u201d compared Marsiglia.<\/p>\n\n\n\n<p>Marsiglia warned of the risks that everyone \u2014 candidates, critics, journalists and judges \u2014 could face when dealing with these new rules. Assis, on the other hand, pointed out a critical vulnerability: \u201cThe main one is the subjectivity in identifying so-called disinformation, a concept that varies according to the place and the definition.\u201d<\/p>\n\n\n\n<p>\u201cIn the Brazilian legal framework, this is still not well defined, becoming a subjective issue for each judge or person who makes the complaint,\u201d added Assis, highlighting the practical difficulties that this lack of definition can cause.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>The importance of quality public debate for democracy<\/strong><\/h3>\n\n\n\n<p>Marsiglia also highlighted the importance of public debate as an essential tool for preserving and strengthening democracy. \u201cWe understand that quality public debate, with depth and genuine openness to plurality, is the best way to find possible solutions to address the problems that threaten democracy,\u201d he said.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>360\u00ba Conversation: Space for exchange and learning<\/strong><\/h3>\n\n\n\n<p>Every month, RenovaBR hosts Conversa 360\u00b0, an event dedicated to exploring electoral topics, good practices in the public sector and political trends.
